Updates for clients in Germany

Starting August 1, 2025, Kraken will directly provide crypto services to clients in Germany through our new MiCA-regulated entity, Payward Europe Solutions Limited (PESL).

Summary of the Updated Kraken EEA Terms of Service

From August 1, 2025, Kraken will update its Terms of Service to align with new EU-wide regulatory standards, called MiCA (Markets in Crypto-Assets regulation). Once these changes take effect, your crypto services will be handled by Kraken’s Irish entity (Payward Europe Solutions Limited).

You can review the updated Terms of Service in full via this link. A summary of what’s changing is outlined below. Should you prefer not to accept these changes, you can choose to close your Kraken account before August 1, 2025 by reaching out to our support team. If we don’t hear from you, we’ll assume you accept the changes as of 1 August in relation to all of our services except e-money services, and as of 29 September in relation to our e-money services.

After August 1:

  • If you are a DLT-verified client, log in to your Kraken account and review the updated EEA Terms of Service in full to understand how these changes may affect you.

  • These terms of service take effect on 1 August 2025 (except for terms related to our e-money services,  defined as our E-money Core Services Terms in our EEA Terms of Service, which will come into effect on 2 September 2025).

If you decide not to accept the updated Terms of Service, you'll need to close your account and withdraw any remaining funds. For guidance, check out our support article on how to close your account.

By mid August, 2025, you'll no longer be able to view deposit addresses associated with DLT Finance on your account.

Once you log in to your account, you will be prompted to generate a new crypto deposit address. If you previously had a Kraken deposit address you will be able to continue using your old one. 

You’ll have access to Kraken’s full range of cryptocurrencies, with the exception of those restricted under EEA regulations. You can view the list of restricted assets here.

Additionally, you’ll be able to take advantage of our staking features, allowing you to earn rewards on select crypto holdings. 

Starting August 1, you will be able to use Kraken’s standard funding methods for both domestic and international deposits and withdrawals. This includes full access to EUR funding options shown below:

  • Tailored for EEA Clients and Local Rules: Kraken has updated its Terms to better suit clients in the European Economic Area (EEA). This means the Terms now follow the latest local regulations, and clearly explain which Kraken entity provides your services.

  • Clearer Product Information: Kraken has reorganised its Terms so it’s easier to understand which rules apply to each of its products. Each product now has its own section, making it easier for you to know what to expect.

  • Better Help with Complaints: Kraken has introduced a more detailed process for handling complaints. If you have a concern, you’ll know how to raise it, how Kraken will handle it, and where to go for further help.

  • More Clarity on Responsibility: Kraken has provided more detail on when and how it may be responsible if something goes wrong. The updated Terms also explain when Kraken’s responsibility is limited, in line with legal requirements. This helps you understand when you might be able to claim compensation.

  • When Accounts Can Be Closed or Paused: Kraken has clarified the situations in which it may suspend or close your account. The Terms also explain whether you’ll receive notice before this happens.

  • Portfolio Management Services: New terms have been added for our new portfolio management services.

  • Better Consumer Protection and Transparency: As required under the new EU regulations, Kraken has improved its explanation of the risks that come with using its services, so you can make more informed decisions. The updated Terms also give clearer details about fees, including transaction costs, price spreads, and charges for specific services.
