For FATCA purposes, a U.S. person generally includes:
A U.S. citizen, including individuals who hold U.S. citizenship even if they live outside the United States;
A U.S. tax resident, including a lawful permanent resident/green card holder or an individual who meets the U.S. substantial presence test;
A partnership or corporation created or organized in the United States or under U.S. state law;
An estate that is not a foreign estate;
A trust if a U.S. court can exercise primary supervision over the trust’s administration and one or more U.S. persons control all substantial decisions of the trust; and
The U.S. government, U.S. states, the District of Columbia, and certain agencies or instrumentalities.
