The Promotion begins on 18 December 2025 at 12:00 PM UTC and ends on 16 January 2026 at 12:00 PM UTC (“Promotion Period”).

To participate in this Promotion, you must:

1. Have a Kraken Pro account verified to at least Intermediate level.
    
2. During the Promotion Period, click “Join Now” on the campaign page to register.
    
   • Participation is limited to the first 1,000 eligible users who click “Join Now,” on a first-come, first-served basis.
      
   • Users may still trade without being eligible for a reward after the cap is reached.
      
3. After joining, trade the eligible perpetual futures contract: NIGHT perpetual futures (NIGHT-PERP).
    
   • Only trading volume after you click “Join Now” qualifies.
      
   • Opening and closing trades both count toward total notional volume.
      

No purchase is required to create a Kraken account.

Rewards consist of $NIGHT token airdrops credited to eligible participants’ Kraken Spot Wallets.

For each of the first 1,000 eligible participants who meet the minimum trading volume threshold during the Promotion Period, the reward tier is determined as follows:

Participants who do not meet the minimum trading volume threshold receive no reward.

Each participant may receive only one (1) reward.

You are eligible to participate if, at the time of entry and throughout the Promotion Period, you:

• Reside in an Eligible Area;
   
• Agree to the Kraken.com Terms of Service and these Rules;
   
• Have a Kraken Pro account verified to Intermediate level or higher;
   
• Are not otherwise prohibited from using Kraken’s services.
   

By entering, you represent and warrant that you satisfy all eligibility requirements.

Kraken reserves the right to disqualify any participant if Kraken determines, in its sole discretion, that the participant:

• Violated these Rules or the Kraken.com Terms of Service;
   
• Engaged in abusive, manipulative, or fraudulent trading activity;
   
• Attempted to circumvent limits or otherwise acted in bad faith.

Rewards will be issued automatically to the Spot Wallet of each eligible participant whose account is active, verified, and in good standing at the time of issuance.

Kraken may request additional information to confirm eligibility before issuing a reward.

If a participant’s account is closed, suspended, or otherwise ineligible at the time of issuance, the reward may be withheld or forfeited.

By entering the Promotion, you consent to Kraken’s use of any information submitted or collected for:

• Administration of the Promotion;
   
• Compliance with applicable laws and regulations;
   
• Delivery of communications, including marketing communications.
   

Your identifying information may be disclosed to third parties when required for Promotion administration, regulatory compliance, tax reporting, or other lawful purposes.

Kraken is not responsible for:

• Internet outages or technical issues affecting participation;
   
• Delays or failures caused by events outside Kraken’s control, including acts of God, natural disasters, war, terrorism, epidemics, civil disturbances, or government actions.

By participating, you release Kraken and all related parties from any Claims arising from participation or receipt of any reward.

To the maximum extent permitted by law:

1. All disputes must be resolved individually, without class actions.
    
2. Damages are limited to actual, out-of-pocket expenses not exceeding $25, and attorneys’ fees are not recoverable.
    
3. No punitive, incidental, consequential, special, or multiplied damages are permitted.
    

Any dispute arising out of or related to this Promotion is governed by the laws of England and Wales, without regard to conflict-of-laws principles.

Disputes must be resolved through confidential binding arbitration in London, England, under LCIA rules.

Kraken may seek equitable relief in any competent court.

If any provision of these Rules is unlawful or unenforceable, it shall be modified or removed to the minimum extent necessary while the rest of the Rules remain valid.

Kraken may modify, suspend, or cancel the Promotion at any time.
Kraken’s decisions are final in all matters relating to the Promotion.

Failure to enforce any provision does not constitute a waiver.

If the Promotion cannot run as planned for any reason, Kraken may cancel, modify, or suspend the Promotion and determine reward recipients from eligible entries received up to that point or in another manner deemed fair and appropriate.
